Topic 1: Family Violence
Topic 1: Family Violence
Following the release on 28 February 2015 of the report of the Special Taskforce on
Domestic and Family Violence, headed by former Governor-General Quentin Bryce the
current Queensland government began implementing a raft of changes to domestic violence legislation and policy. The first wave of amendments was passed on 15 October 2015; the second received assent on 17 December 2015 and the Criminal Law (Domestic Violence) Amendment Act 2016 was assented to on May 5th, 2016. A fourth bill (Domestic and Family Violence Protection and Other Legislation Amendment Bill 2016) was presented to the Queensland Parliament on August 16, 2016.
How effective are these amendments to the Domestic and Family Violence Protection Act 2012 in protecting victims of family violence?
Topic 2: International Child Abduction
Australia has one of the highest rates per capita of international parental child abduction in
the world. However, with the exception of cases where a family court order restricting
travel is already in place, international parental child abduction is not a criminal offense in
Australia. Australia is a signatory to The Hague Convention on the Civil Aspects of
International Child Abduction which is the main international agreement that covers
international parental child abduction. It provides a process through which a parent can
seek to have their child returned to their home country.
Does the Hague Convention provide adequate protection for stakeholders in cases of
international child abduction or should the Federal Government enact legislation to
criminalize the act of international child abduction in Australia?
